TERMS OF USE FOR THE ONLINE COUNSELLING SERVICE OF CARITAS SALZBURG
1. Subject matter – anonymous counselling
1.1 The Caritas Association of the Archdiocese of Salzburg ("Caritas") offers those seeking advice free of charge and - if desired completely anonymously - the opportunity to access the experience and expertise of Caritas staff. The pool of experts covers the entire range of services offered by Caritas Salzburg, and counselling is provided online in a technically completely anonymous environment if desired.
1.2 It should be noted that important legal, medical, psychological, economic and other serious situations always also require personal, more in-depth counselling, for which the (anonymous) online counselling provided by Caritas is no substitute.
2. Registration, user account and use of the services
2.1 The use of the services is only possible with prior registration on the platform, whereby no personal data must be disclosed. Each registered user receives his/her own user account for an unlimited period of time. A user may only register with one account, multiple registrations are not permitted. An exception is the instant chat, which can be used without registration.
2.2 In the course of registering on the platform, it is possible to enter an individual, freely selectable user name (fantasy name, pseudonym, etc.) and an equally freely selectable password, which are required for anonymous counselling. The user name and password are to be treated as strictly confidential and may not be made accessible to third parties. If users suspect that their password has become known to a third party, Caritas must be informed immediately so that the account can be blocked or the password changed. In the event of misuse, users are liable according to the care they have taken. The use of online counselling is anonymous. The information provided to Caritas can therefore not be assigned to any person.
2.3 Certain actions may be harmful to others and may also have legal consequences for you. For this reason, for your own protection and the protection of our employees, you are not allowed to perform such actions on our platform. In the event of harassment, insult and other improper behaviour towards our employees, this behaviour will result in immediate termination of the services, deletion of your data and, if relevant, legal action.
3. Liability
3.1 The scope of the services offered in each case corresponds to the availability of the employees. The services offered by Caritas are voluntary and free of charge. The duration, scope and intensity of online counselling may vary depending on staff capacities or may be suspended altogether.
3.2 Caritas shall be liable for itself or its vicarious agents only for damage caused by gross negligence or intent; in this case, liability shall be governed by the applicable statutory provisions. Liability for damages due to slight negligence, as well as for consequential damages, lost profits, loss of data or other indirect or incidental damages is excluded.
4. Technical Requirements
4.1 In order to use the services, internet access and an appropriate, up-to-date end device including browser are required, which have the technical capacities for the graphic display of the platform. The use of the services generates a considerable volume of data, which may result in costs, especially in the case of mobile use. The costs and risk of internet data traffic lie exclusively with the users.
4.2 Users are aware that due to the technical nature of the internet, there can never be complete protection against viruses, Trojans, spyware, etc. Caritas cannot guarantee this protection. Caritas can therefore not guarantee this protection. Caritas does not guarantee a certain availability of the services and expressly reserves the right to interrupt them for technical or other reasons.
4.3 Caritas cannot guarantee that access to the platform is possible at all times without interruption and without errors. Caritas is not liable for disruptions or impairments that are not within its sphere of influence.
5. Use of benefits in kind or cash benefits as well as benefits from other Caritas facilities
5.1 The Caritas online counselling service is a service of the Caritas Salzburg social counselling service that provides low-threshold access to counselling services in an anonymous form, if desired. If it becomes apparent during the online counselling that there is a possibility of support for the user through counselling or also benefits in kind or money from another Caritas institution, the user will be made aware of this and referred to the respective Caritas institution. In this context, no data is collected and transmitted to institutions. The user is free to contact the respective institution him/herself.
5.2 In order to enable certain support services by way of online counselling (social counselling) (payment of money, benefits in kind), the user's data is required. The data will be stored by Caritas as the disbursing agency for up to 10 years (depending on the support service and funding agency) as proof for the respective funding agency and, if necessary, transmitted to the respective funding agency upon request.
Without the user's personal data, such as name, address, gender, origin, date of birth, marital status, nationality, key figures (AIS/IFA number), income, support cannot be granted.
6. Forms of use
6.1. Anonymous online counselling in chat: It is not necessary to provide personal data for anonymous online counselling; counselling can be anonymous and under a pseudonym. Data can be disclosed voluntarily. If support services are used, point 5.2 applies.
6.2. Online counselling via video chat or online telephone call: A user may be identifiable through real-time video chat or online telephone calls. This means that the data disclosed in this way is collected in a personal manner. Further processing of the data (storage, forwarding) does not take place.
7. Data protection
7.1. Parts of our counselling can be used anonymously. For others, we need your personal data. This is the only way we can optimally accompany you during the counselling. All data disclosed will be treated confidentially and in compliance with the provisions of the DSG and the DSGVO. All information on data processing, your rights and the contact details of the responsible persons can be found in the privacy policy on the website.
7.2. The data protection information sheet for online counselling in accordance with Art. 13 DSGVO is available separately.
